These terms govern your use of the Pros Home Consulting website and the lead generation services we provide to home service contractors. By using the site or engaging us, you agree to them.

The service

We build and run advertising campaigns that generate requests from homeowners for services such as roofing, HVAC and tree work, and we deliver those requests to contractors in the relevant trade and territory. We limit the number of contractors we work with in each trade and territory. Territory availability is confirmed before you begin and is not guaranteed until agreed in writing.

Eligibility

The service is for businesses. You confirm that you are authorized to enter into these terms for your company and that you hold any licenses, insurance and registrations required to perform the work you advertise.

Lead exclusivity

We deliver each lead to one contractor only and do not resell it. Exclusivity applies to the lead as delivered by us; we cannot control whether a homeowner independently contacts other businesses.

Qualified leads and replacements

A qualified lead is a homeowner located in your agreed service area who requests a service you offer, with a working phone number and a plan to hire in the near term. If a delivered lead does not meet these criteria, report it to info@proshomeconsulting.com within 72 hours of delivery and we will replace it at no cost. We do not guarantee that any lead will result in a job, a sale or any particular revenue.

Fees, billing and cancellation

Pricing is quoted per lead before you begin and depends on trade and market. Unless agreed otherwise in writing, service is month-to-month. You may pause or cancel with notice before your next billing period. Fees for leads already delivered remain due. We may change pricing with advance notice, and changes apply to the next billing period.

Your responsibilities

• Provide accurate information about your business, trades and territory.
• Contact homeowners lawfully, including honoring do-not-call requests and applicable calling and texting laws.
• Treat homeowner information with care and use it only to respond to that homeowner’s request.
• Do not resell, share or republish leads, or misrepresent your relationship with us.

Website use

Do not misuse the site, attempt to disrupt it, submit false or another person’s information, or use automated means to scrape it. Content on this site, including text, design and logos, belongs to Pros Home Consulting and may not be copied without permission.

Calls and text messages

By submitting our form with the consent box checked, you agree that we may contact you by phone, text and email about our services, including by automated means. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out. See our Privacy Policy.

Disclaimers

The site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Example leads and figures on the site are illustrative.

Limitation of liability

To the fullest extent permitted by law, Pros Home Consulting will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the services will not exceed the fees you paid us in the three months before the claim arose.

Indemnification

You agree to defend and indemnify us against claims arising from your work for homeowners, your breach of these terms, or your violation of any law.

Termination

Either party may end the service as described above. We may suspend or end service immediately if you breach these terms or misuse leads.

Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York.

Changes

We may update these terms. The date above shows the latest revision, and continued use after a change means you accept it.
